I. Subject matter

These General Terms and Conditions regulate the relations between La Fit Trans Ltd., with registered office and management address in Sofia, 36A Patriarch Evtimiy Blvd., UIC 201235028, hereinafter referred to as the PROVIDER, and the users, hereinafter referred to as USERS, of the translation service, hereinafter referred to as the SERVICE.

III. Description of the SERVICE

La Fit Trans Ltd. provides services for the management, performance and delivery of submitted requests for translation and legalization of documents and other related services (online, in original form or otherwise, including courier services).

The SERVICE is provided both online, through a client platform, and through a network of translation service offices.

For the online provision of the service, the PROVIDER provides an online profile, which includes the following:

  • Internet access address;

  • Access to a personal online profile;

  • Option to submit an online request for translation and/or legalization of documents;

  • Option to upload and download files online;

  • Option to view submitted orders, services and files online;

  • Option to receive the result of the service online and/or by courier;

  • Option to receive accounting documents online and pay them;

  • Option to communicate with the PROVIDER’s customer support center;

  • Information database for document legalization;

  • Statistical information;

  • Option to manage the submitted personal data;


USERS of the SERVICE are natural persons and legal entities that conclude an online contract under these terms with the PROVIDER.

Natural persons use the SERVICE for personal purposes and are consumers within the meaning of the Consumer Protection Act.

USERS who use the SERVICE for commercial, business or professional activity declare that they are not consumers within the meaning of the Consumer Protection Act.

The owner of the profile is deemed to be the natural person or legal entity that made the first payment for the SERVICE.

IV. Price of the SERVICE

The PROVIDER provides the SERVICE for remuneration payable by the USER according to a general or individual price list. Each USER may download an individual price list online from their profile.

A SERVICE related to the translation of documents is charged on the basis of translated pages, not submitted pages. One translated page means 1,800 characters including spaces.

Where the PROVIDER has to pay for additional services to third parties related to the performance of the SERVICE, the USER undertakes to pay for such services, including but not limited to state and/or institutional fees, courier service costs, bank charges and similar expenses.

V. Provision of the service

In order to use the SERVICE online, the USER must register at the PROVIDER’s Internet address. The USER undertakes to enter true and up-to-date data in the registration form and subsequently in the “Profile” section. The USER undertakes to maintain up-to-date personal data in the online profile.

By selecting the registration button, contractual relations arise between the USER and the PROVIDER in accordance with these General Terms and Conditions.

After registration, the USER may, by using the login data entered by the USER, access the client profile and use the online profile created by the USER.

The USER undertakes to use the SERVICE in good faith and in accordance with these General Terms and Conditions.

During the use of the SERVICE and the online profile, the USER may not use software, technologies or techniques that could harm the PROVIDER or other USERS of the platform. Otherwise, the USER shall bear criminal liability and access shall be deactivated.

To register a new order, the USER must visit the “Orders” section and select the “New order” button. The USER must then describe the requirements for the order and upload the files for translation and/or legalization. After registering a new order, the platform redirects the USER to a separate order profile where a comment may be added to each file. If necessary, the USER adds additional files to the order.

After the order is registered, an operator from the PROVIDER’s customer service center takes over the order and begins processing it, contacting the USER for clarification if necessary.

If necessary, a representative of the PROVIDER issues a pro forma invoice/invoice in the USER’s profile for advance payment. After payment of the document in the manner chosen by the USER, processing of the order begins.

After the order is processed and completed, the USER receives the completed documents online, at an office of the PROVIDER and/or by courier service.

VI. Amendments to the General Terms and Conditions

These General Terms and Conditions may be amended by the PROVIDER at any time, after which the PROVIDER is obliged to notify the USERS of the SERVICE in an appropriate manner.

All changes to the General Terms and Conditions enter into force at the moment of notification. The USER has the right to reject the changes within 14 days, in which case the USER agrees that access to the online profile will be deactivated.

The USER agrees that an email notification sent to the USER is sufficient, regardless of whether it has been read. The USER agrees that information published in the dashboard of the online profile is sufficient notification of a change to these General Terms and Conditions, regardless of whether it has been read.

VII. Termination

The contract for the provision of the service is terminated:

  • By mutual agreement of the parties;

  • Upon bankruptcy or liquidation of one of the parties to the contract;

  • Unilaterally by either party.


In the event of termination by the USER, the USER is obliged to pay for all used services and obligations. In the event of termination by the PROVIDER, the PROVIDER is obliged to provide all orders submitted by the USER that have been processed, after they have been paid for.

The PROVIDER has the right to terminate the contract at any time if it establishes that the online profile and/or the services used are being used in violation of these General Terms and Conditions, the PROVIDER’s policies, the legislation of the Republic of Bulgaria, etc.

VIII. Responsibilities

The USER is obliged to pay for all SERVICES used, including by advance payments. Otherwise, the PROVIDER has the right to seek its rights through court proceedings.

The USER is obliged not to attempt to access personal data of other USERS. Otherwise, the USER’s data will be provided to the authorities of the Ministry of Interior and the USER will be investigated for attempted theft of personal data. The PROVIDER has taken the necessary measures to detect such attempts.

The USER is obliged not to provide false documents for translation and/or legalization. Otherwise, only the USER bears criminal liability. The PROVIDER is not obliged and has no authority to verify the validity of the documents that it translates and/or submits for legalization.

The PROVIDER is obliged to process and store the USER’s personal data in accordance with the company’s privacy policy.

The PROVIDER is obliged to provide the USER with the requested SERVICE, if it has been duly paid for and if force majeure does not prevent this. If the SERVICE cannot be provided and no costs have been incurred for it due to the USER’s fault, it shall not be paid for. If, due to the USER’s fault, costs have been incurred by the PROVIDER, the USER is obliged to pay them.

The USER is obliged to pay for all orders submitted through the USER’s online profile, regardless of whether they were made personally or whether the USER provided the login data to third parties. This obligation also applies in the event of theft of the login data by third parties and use of the profile on behalf of the USER. The PROVIDER is not responsible for the storage of login data for the online platform by the USER.

IX. Other provisions

The USER and the PROVIDER undertake to keep confidential any trade secrets that become known to them during the performance of this contract.

The USER and the PROVIDER undertake not to make the correspondence between them public, even after termination of the contract.

If an offline written contract is concluded between the parties and there is a conflict between that contract and these terms, the provisions of the offline written contract shall prevail.

All disputes related to these General Terms and Conditions that cannot be clarified between the parties to the contract shall be referred for resolution to the Arbitration Court at the Bulgarian Chamber of Commerce and Industry. If the USER is a consumer within the meaning of the Consumer Protection Act, the dispute may be referred to the competent Bulgarian courts.

These General Terms and Conditions are effective from the moment of their publication on the PROVIDER’s Internet website.
Privacy
I. General information

This personal data protection policy has been prepared and is applied by La Fit Trans OOD (hereinafter referred to as “La Fit Trans” or the “Controller”) in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “Regulation (EU) 2016/679”), in force as of 25.05.2018, and in accordance with the Bulgarian Personal Data Protection Act.

In its capacity as a personal data controller, La Fit Trans complies with all legal requirements, including the new regulation, collecting data of individuals only to the extent necessary for providing the service, and storing it responsibly and lawfully.

This policy aims to provide users with information about every aspect of the processing of personal data by the Controller, as well as about the rights arising from such processing.

III. Purposes, principles and grounds for collecting, processing and storing personal data

La Fit Trans is an agency for translation and legalization of documents and other papers of various types, certified under ISO 17100:2015-05 and ISO 9001:2008. In view of the Controller’s activities, in order to provide its services it collects and processes personal data while complying with the requirements of Regulation (EU) 2016/679.

La Fit Trans collects and processes personal data for the following purposes:

  • Creating a customer account and providing access to our customer platform, including identification where necessary, for example when concluding a contract;

  • Managing, performing and delivering submitted translation and legalization services and related similar services (online, in original form or otherwise, including courier services);

  • When providing the offered services, collecting and processing personal data related to the requirements under the Rules for Legalizations, Certifications and Translations of Documents and Other Papers, approved by Decree No. 184 of the Council of Ministers of 1958, promulgated in State Gazette No. 73 of 12.09.1958, amended in Nos. 10 of 04.02.1964, 77 of 28.09.1976, 96 of 07.12.1982, 77 of 04.10.1983, 103 of 25.12.1990, amended and supplemented in No. 95 of 28.11.2017, in force as of 01.03.2018;

  • Accounting purposes;

  • Ensuring the performance of the provided service;

  • Sending information notices, notices of changes to the service, recommendations for improving the use of the service and other related messages;

  • Improving and personalizing the service.


When processing personal data, La Fit Trans observes the following principles:

  • lawfulness, fairness and transparency;

  • purpose limitation;

  • relevance to the purposes of processing and minimization of the collected data;

  • accuracy and keeping data up to date;

  • storage limitation in view of achieving the purposes;

  • integrity and confidentiality of processing and ensuring an appropriate level of security of personal data.


When processing and storing personal data, the Controller processes and stores personal data in order to protect its legitimate interests, such as fulfilling its obligations to the National Revenue Agency, the Ministry of Interior, the Consular Relations Directorate at the Ministry of Foreign Affairs, the Ministry of Justice, NACID and other state and municipal institutions.

IV. What types of personal data the Controller collects, processes and stores

La Fit Trans carries out personal data operations for the following purposes:
  • Registration of a user in the Controller’s information system and creation of a customer account (for example full name, personal identification number, foreigner’s personal number, telephone, email, address, etc.);

  • Customer number created by La Fit Trans for user identification;

  • Sending information notices and communication regarding a completed service or issued invoice;

  • Other personal data provided personally or by a third party in connection with and during the performance of the services.


La Fit Trans processes your personal data on the basis of Art. 6, letter a) of Regulation (EU) 2016/679, which governs the cases where the user gives consent to the processing of their personal data for one or more specific purposes.

In addition, La Fit Trans processes your personal data on the basis of Art. 6, letter b) of Regulation (EU) 2016/679, which governs cases where “processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”.
In view of the legal requirements applicable to the Controller, it processes data relating to a legal obligation and legitimate interest in relation to the NRA, the Consular Relations Directorate at the MFA, the Ministry of Justice, NACID and others, such processing grounds being governed by Art. 6, letters c) and f) of Regulation (EU) 2016/679.

By accepting the general terms and conditions, registering and creating a customer account in the customer platform and website of La Fit Trans, as well as by providing documents and other papers for translation and/or legalization, contractual relations are created between the user and the Controller, on which basis your personal data is processed.

Each of the actions described above provides grounds and consent for the processing of any additional information provided by the user. When using the La Fit Trans customer platform, the user also agrees to the collection of data such as an IP address for the purpose of improving security and localization.

The persons who process personal data on behalf of La Fit Trans are persons hired under civil, employment or other contracts, who perform various stages of the overall management, performance and delivery of the service provided.

La Fit Trans does not carry out automated decision-making with data.

V. Period of storage of personal data

La Fit Trans stores personal data for a period no longer than the existence of the customer account in the customer platform.

La Fit Trans stores personal data that it is required to keep under applicable legislation for the relevant statutory period, which may exceed the period of existence of your registration.

VI. Transfer of personal data for processing

La Fit Trans may, at its discretion, transfer part or all personal data to personal data processors for the fulfillment of the processing purposes, in compliance with the requirements of Regulation (EU) 2016/679, for example by providing a delivery address to a courier company.

La Fit Trans will notify you if it is necessary to transfer part or all of your personal data to third parties and/or state/international organizations.

VII. Your rights when your personal data is collected, processed and stored

1. Withdrawal of consent for the processing of your personal data

If you do not want all or part of your personal data to continue being processed by the Controller for a specific purpose or for all purposes of processing, you may withdraw your consent to processing at any time by request via email or through your customer account.

If consent is withdrawn for the processing of personal data that is mandatory for creating and maintaining your registration for use of the services, your account will be cancelled.

2. Right of access

Every user has the right to request and receive confirmation from La Fit Trans as to whether personal data related to them is being processed.

Every user has the right to access the data related to them, as well as information concerning the collection, processing and storage of their personal data.

Upon request, La Fit Trans provides a copy of the personal data being processed and related to you in electronic or other appropriate form.

3. Right to rectification or completion

Every user may correct or complete inaccurate or incomplete personal data related to them directly through their customer account.

4. Right to erasure (“right to be forgotten”)

Every user has the right to request La Fit Trans to erase personal data related to them, and the Controller is obliged to erase it without undue delay where one of the following grounds applies:

  • the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;

  • the user withdraws the consent on which the processing is based and there is no other legal ground for the processing;

  • the personal data must be erased for compliance with a legal obligation under EU law or the law of a Member State applicable to the Controller;


La Fit Trans is not obliged to erase personal data if it stores and processes it as follows:

  • for exercising the right of freedom of expression and information;

  • for compliance with a legal obligation requiring processing under EU law or the law of the Member State applicable to the Controller, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;

  • for reasons of public interest in the area of public health;

  • for the establishment, exercise or defense of legal claims.


To exercise your right to be forgotten, you must submit a request through the option in your customer account or a written request sent to the Controller, and verify your identity and identity with the person to whom the data relates by presenting your identity card on site for identification purposes and, if necessary, entering the login details for the account of the person to whom the data relates before a representative of the Controller.

The Controller does not erase data that it has a legal obligation to store, including for protection in connection with legal claims brought against it or to prove its rights.

5. Right to restriction

Every user has the right to require the Controller to restrict the processing of data related to them when:

  • they contest the accuracy of the personal data, for a period enabling the Controller to verify the accuracy of the personal data;

  • the Controller no longer needs the personal data for the purposes of processing, but you require it for the establishment, exercise or defense of legal claims;

  • they object to processing pending verification whether the Controller’s lawful grounds override the interests of the user.


6. Right to portability

Every user has the right at any time to download the data stored and processed about them in connection with the use of the Controller’s services, by request via email or through the customer platform.

Every user has the right to request the Controller to directly transfer the personal data to another controller designated by them, where technically feasible.

7. Right to receive information

Every user has the right to request the Controller to be informed about all recipients to whom the personal data for which rectification, erasure or restriction of processing has been requested has been disclosed. The Controller may refuse to provide this information if this would be impossible or would involve disproportionate effort.

8. Right to object

Every user has the right to object at any time to the processing of personal data by the Controller relating to them, including where it is processed for profiling or direct marketing purposes.

9. Your rights in the event of a personal data security breach

If La Fit Trans establishes a personal data security breach that may result in a high risk to your rights and freedoms, it will notify you without undue delay of the breach and of the measures that have been taken or are to be taken.

La Fit Trans is not obliged to notify you if:

  • it has implemented appropriate technical and organizational protection measures with regard to the data affected by the security breach;

  • it has subsequently taken measures which ensure that the breach is not likely to result in a high risk to your rights;

  • notification would involve disproportionate effort.


VIII. Competent authority for personal data protection

In the event of a violation of your rights under the above or under applicable personal data protection legislation, you have the right to lodge a complaint with the Commission for Personal Data Protection as follows:
